SITE INFORMATION

Terms and Conditions

How this historical archive is presented, credited and used.

These terms explain how TexasFreeway.com presents its archive and how material on the site may be used. By using the site, you agree to these terms. If you do not agree, please stop using the site.

Found a photograph that helps tell your story? We welcome links to TexasFreeway pages and individual photographs within their collections. Linking to the collection keeps the image together with its historical context, caption and available credit.

  1. Open a photograph using its image or Enlarge control.
  2. Choose Copy link & credit at the bottom of the viewer. Paste into your document, email or editor. Where supported, the pasted text includes a clickable link; otherwise it includes the address as plain text.
  3. For a website editor’s HTML or source-code view, choose Copy HTML attribution. Paste that code to include the photograph’s title, available date and credit, and a link back to its place in the TexasFreeway collection.

To share a whole page, copy its address from your browser. Please retain the supplied photographer or source credit when sharing an attribution, and do not imply that TexasFreeway owns a photograph simply because it appears here. The copy tools create a link and attribution; they do not embed the image or grant permission to reproduce it. Image reuse is governed by the rights described above.

About the archive

TexasFreeway documents Texas roads and transportation history. Much of the archive preserves older writing, photographs, maps, documents and descriptions as they appeared at the time. Dates, plans, businesses, road conditions and links in historical material may no longer be current. Archived material describes its period; it is not a statement of present-day conditions.

Accuracy and practical use

We work to describe sources honestly and to correct material when appropriate, but we cannot promise that every page is complete, error-free or current. Do not rely on the archive for current road conditions, navigation, construction schedules, safety instructions, engineering decisions or legal requirements. Verify current information with the responsible public agency or another authoritative source.

Use the archive with the judgment appropriate to historical and third-party material. To the extent permitted by law, TexasFreeway is not responsible for loss caused by reliance on material that is outdated, incomplete or outside its control.

Copyright, credits and reuse

TexasFreeway’s original writing and site design are distinct from the third-party material collected here. The archive also contains photographs, maps, documents, excerpts, trademarks and other material credited to photographers, publishers, archives, government agencies and other third parties. Rights in that material remain with the applicable owners unless an item-specific rights statement says otherwise.

A credit or source label records provenance. It does not by itself grant permission, transfer ownership or establish that an item is free of copyright restrictions. Use material only when an item-level rights statement permits it, the rights holder grants permission or applicable law otherwise allows the use. TexasFreeway cannot grant reuse rights for material it does not own.

Read the TexasFreeway Copyright Notice for the site’s general reuse rules. Those rules do not give TexasFreeway authority to license third-party material.

Historical commentary and fair use

TexasFreeway explores how Texas roads were imagined, built and experienced. Photographs, maps and publications are evidence of that history: a proposed route can reveal an abandoned ambition; a construction photograph can show how a city changed around a road. Our purpose is to help readers understand that evidence through historical context, comparison and commentary.

Where appropriate, TexasFreeway relies on fair use under Section 107 of the U.S. Copyright Act for criticism, comment, scholarship and research. Other material may be used with permission, under a license or because it is in the public domain. We respect the rights of photographers, authors, publishers and other copyright holders.

Our editorial standards call for meaningful analysis alongside selected source material, clear separation of new commentary from preserved historical accounts, and retention of available credits and dates. When assessing fair use, those standards require consideration of:

  • Purpose and character: what the particular use contributes to understanding the history, including its commercial context.
  • Nature of the work: its factual or creative character and whether it was published.
  • Amount used: how much is needed for the specific discussion, including the significance of the portion shown and the resolution provided.
  • Market effect: whether our use could substitute for the original or affect a legitimate market for the work, including licensing.

If you own rights in material shown here and have a concern, please contact us about copyright or permissions. Include the page or photograph link, identify the work and your relationship to it, and explain the concern or correction requested. We will review the information and, where appropriate, correct the credit, change the use, seek permission or remove the material.

For further explanation, see the U.S. Copyright Office’s guide to fair use. Our use of an item does not establish that someone else’s reuse would also qualify.
